About these Terms

These Terms of Service (“Terms”) govern your access to and use of the website at simplesciencesupplements.com (the “site”) and all products and services we offer through it. They form a legally binding agreement between you and Simple Science Supplements Ltd (“Simple Science”, “we”, “us”, or “our”).

By browsing the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

Eligibility

Our products are food supplements intended for adults. By placing an order, you confirm that you are at least 18 years old and that you have the legal capacity to enter into a binding contract.

If you are buying on behalf of a business, you confirm that you have authority to bind that business to these Terms.

Your account

You may browse and purchase from the site without creating an account. If you do create an account, you are responsible for keeping your sign-in details and any one-time access link sent to you secure, and for all activity that occurs under your account.

You agree to provide accurate and current information about yourself when you sign up and at checkout (including your name, email address, billing address, delivery address, and payment details), and to keep that information up to date so we can fulfil orders and contact you about them.

We may suspend or close an account if we reasonably believe it has been used in breach of these Terms or to commit fraud or other unlawful activity.

Our products and services

We sell food supplements and related products in the United Kingdom. Product descriptions, ingredients, and images are provided in good faith and we make every effort to ensure they are accurate. Colours displayed on screen may vary slightly from the actual product because of differences between displays.

Food supplements are not a substitute for a varied, balanced diet and a healthy lifestyle. They are not intended to diagnose, treat, cure, or prevent any disease. If you are pregnant, breastfeeding, taking medication, or have a medical condition, please consult a healthcare professional before taking any supplement. Discontinue use if you experience any adverse reaction and seek medical advice. Keep all products out of reach of children. See our Health and product disclaimer below.

We may add, change, withdraw, or discontinue products or services at any time without notice.

Pricing and availability

Prices on the site are quoted in pounds sterling (GBP) and are inclusive of UK VAT where applicable. Delivery charges, where they apply, are shown at checkout before you confirm payment.

We try hard to make sure prices and stock levels on the site are accurate, but errors do occasionally happen. If we discover an error in the price of a product you have ordered, we will let you know as soon as possible and give you the option to confirm the order at the correct price or cancel it. If we cannot reach you, we may treat the order as cancelled and issue a full refund.

If a product becomes unavailable after you have placed an order, we will let you know as soon as possible and refund any amount you have paid for that item.

Orders and contract formation

Placing an order through our checkout is an offer by you to buy the products in your basket. We accept your offer (and a contract is formed between us) when we send you a dispatch confirmation email for the products in your order. Until then, no contract exists, even if your card has been authorised.

We reserve the right to decline or cancel an order before dispatch if, for example:

  • the product is out of stock;
  • there is an error in the listed price or product description;
  • we suspect fraud, abuse, or breach of these Terms; or
  • we cannot fulfil delivery to the address provided.

If we decline or cancel an order, we will refund any payment you have made for that order in full.

Use of the site

You may use the site for lawful purposes only. You agree not to:

  • use the site in any way that breaches any applicable local, national, or international law or regulation;
  • use the site for any fraudulent, deceptive, or unlawful purpose;
  • send, knowingly receive, upload, download, or use any material that does not comply with these Terms;
  • transmit any worms, viruses, or any code of a destructive nature;
  • attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer, or database connected to it;
  • interfere with, damage, or disrupt the site, the network, or any equipment used to provide the site;

A breach of this section may result in us suspending or closing your account, declining future orders, and where appropriate reporting the activity to the relevant authorities.

Intellectual property

All content on the site — including the brand name “Simple Science”, logos, product images, photography, illustrations, design, copy, and code — is owned by us or licensed to us and is protected by copyright, trade mark, and other intellectual property laws.

You may view, download, and print pages from the site for your own personal, non-commercial use, provided you do not modify the content or remove any copyright or trade mark notices. You may not otherwise reproduce, distribute, sell, license, or commercially exploit any part of the site without our prior written consent.

Nothing in these Terms grants you a licence to use any of our trade marks for commercial purposes.

Reviews and submissions

If you submit a product review, comment, image, or any other material to the site (a “submission”), you grant us a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, reproduce, edit, publish, and display that submission for purposes connected with the site and our marketing.

You confirm that any submission you make:

  • is your own original work, or you have all necessary rights to share it with us;
  • does not infringe anyone else’s rights (including copyright, trade mark, privacy, or personality rights);
  • is accurate and not misleading;
  • does not contain any unlawful, defamatory, threatening, abusive, obscene, or otherwise objectionable content; and

We are not responsible for the content, products, services, or practices of those third parties, and we do not endorse them. Health and product disclaimer

Statements about our products on the site have not been evaluated by any regulatory body unless expressly stated to be an authorised health claim under retained EU Regulation 1924/2006. Our products are not intended to diagnose, treat, cure, or prevent any disease. Always read the label and follow the directions for use.

Limitation of liability

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • a breach of the terms implied by section 12 of the Sale of Goods Act 1979 or sections 9 to 11 and 13 to 18 of the Consumer Rights Act 2015; or
  • any other liability that cannot be limited or excluded by law.

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for any loss of profit, loss of business, business interruption, or loss of business opportunity (those are not losses you would normally incur as a consumer);
  • we are not liable for any loss or damage that was not reasonably foreseeable at the time you placed your order; and
  • our total aggregate liability arising out of or in connection with any single order is limited to the amount you paid for that order.

We accept no liability for any failure or delay in performing our obligations to the extent caused by events outside our reasonable control (a “force majeure event”), including carrier delays, strikes, severe weather, fire, flood, pandemic, war, civil unrest, or interruptions to internet, telecommunications, or utility services.

This section does not affect your statutory rights as a consumer.

Indemnity

You agree to indemnify and hold us, our employees, agents, and contractors harmless from any losses, damages, costs (including reasonable legal costs), and expenses arising from your breach of these Terms or your unlawful use of the site.

This section does not apply to consumer use of the site for ordinary, personal, non-commercial purposes.

Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.

No waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing to be effective.

Termination

These Terms apply for as long as you use the site. We may suspend or close your account, or restrict your access to the site, if we reasonably believe you have breached these Terms or used the site for fraudulent or unlawful purposes. Termination does not affect any rights or obligations that have already arisen.

You may stop using the site at any time. If you have an account, you may close it by emailing help@simplesciencesupplements.com.

Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices, our service providers, or for operational, legal, or regulatory reasons. When we do, we will update the “Last updated” date at the top of this page. The version of these Terms in force when you placed an order applies to that order.

Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your home jurisdiction.

Your statutory rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
